I have the honor to return herewith the recommendations for the appointment of Ordnance Sergeants in the case of 1^st Serg^t Lewis Bates Co. D 5^th Infantry; Qr. Mr. Sergeant Franklin Rounds 7^th Infantry; Sergeant Major Thomas Riordan 1^st Infantry; Sergeant Blakely Abbott Co F 7^th Infantry; Sergeant George T. A. Nixon Co B 4^th Arty; 1^st Sergeant William Burke Co G 7^th Infantry; 1^st Sergeant Ernest Missor Co E 4^th Arty; 1^st Sergeant William J Allen Co F 2^d Arty; and 1^st Sergeant Hoyt Palmer L 2^d Arty; the service of the last expired 15^th September last. [Sgt P did not re enlist.]

The General-in-chief recommends appointments be made in the order in which the applicants names are above written.

One of the most meritorious non-commissioned officers on the list, (Rounds), is a Qr. Mr. Sergeant, and another (Riordan) Sergeant Major.

These, by a decision made in 1850 are ineligible. The General-in-chief is of opinion that the Sergeant-Major & Qr. Mr. Sergt. are, in the meaning of the law, “Sergeants in the line” — that the decision of 1850 is unjust to the most meritorious of the non-commissioned officers and he requests that the subject be brought before the Secretary of War with the recommendation that the practice prior to 1850 be revived.
