Deputy Ayers had a warrant for Emanuel Patterson on a larceny charge. Late the night of August 11, 1880, Deputy Ayers went to Patterson's house near Cherokeetown in the Chickasaw Nation to serve the warrant. Ayers knocked on the door and entered the house, telling Patterson he was under arrest. Patterson asked Ayers if he could get some clothes on and Ayers agreed. Instead of getting dressed, Patterson picked up a gun and shot the deputy in the head killing him.

August 25, 1880 - The Cherokee Advocate - The report of the killing of U. S. Marshal Willard Ayers, has been confirmed by letters. He was shot on Wednesday night, 11th inst. and only lived about two hours. He was buried at Cherokee town, by his brother, Ben Ayers, Zack Moody and his brother-in-law, who were out on a trip with him. The Negro made good his escape after firing the fatal shot. Two hundred dollars reward has been offered for his capture. Willard Ayers was the eldest son of Mr. Willard Ayers, watchman for the U. S. Treasury at Washington and was born and raised at For Smith. He had been engaged as Deputy U. S. Marshal since 1871, and had made a fine reputation as an officer, as well as a man.
